1.2 These terms and conditions are applicable to the website of ebby port (www.ebbyport.com), the product(s) of ebby port and het all agreements with you.
1.3 By ordering and purchasing items online you accept these terms and conditions.
1.4 All trade relations between you and ebby port shall be governed by and construed in accordance with the Laws of The Netherlands.
Article 2. Intellectual property
2.1 Nothing on this website may be used by you or for third parties. Everything on this website is protected by Dutch copyright laws and other Dutch and international laws and treaties.
2.2 The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the Dutch and other copyright laws, and is the property of ebby port. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with ebby port and purchasing products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with ebby port or to purchase products from the ebby port. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited. You further agree not to change or delete any proprietary notices from materials downloaded from the site.
2.3 Unauthorized use of ebby port’s trademarks, trade names and logos without an explicit written permission is strictly prohibited. The rights of intellectual property regarding the products designed by ebby port belong therefore exclusively to ebby port.
Article 3. Accuracy
3.1 Despite our efforts, the information on this website may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or correctness of any information on this website.
3.2 We make all reasonable efforts to accurately display the attributes of ebby port’s product(s), including the applicable colors. However, the actual colour you see will depend on your computer system and we cannot guarantee that your computer will accurately display such colors.
3.3. ebby port makes all reasonable efforts to accurately indicate the sizes used on this website. However, because all product(s) are handmade the sizes could be slightly different per model.
3.4 Based on that which stated in article 3.1-3.3 ebby port is not obliged to complete and deliver any orders that were placed on the basis of incorrect or incomplete information.
Article 4. Orders
4.1 You can place an order by adding all desired product(s) to your CART, proceeding to the CHECK OUT and paying for the order.
4.2 ebby port will send a confirmation and summary of the order by e-mail including an invoice.
4.3 It is your responsibility to make sure all information that is required and necessary for the execution of the order is correct, complete and up-to-date.
4.4 ebby port reserves the right to refuse to complete an order for any reason and/or to refuse service to anyone at any time in its sole discretion. In this case ebby port will refund the total amount paid for the refused order within 30 days.
Article 5. Prices
5.1 The prices listed on this website are in Euros (€) and include VAT. Shipping costs are not included in the price unless explicitly declared otherwise.
5.2 Any and all customs or import duties and/or local taxes are for your own account.
Article 6. Payment
6.1 Every order will be shipped on the following workday as soon as ebby port has received the complete payment.
6.2 You can pay for the order by using one of the following payment methods:
• Paypal
• Credit card (Visa, MasterCard and American Express)
• iDEAL (only for The Netherlands)
• (International) banktransfer. In this case the full amount should be transferred within 7 working days after the date of the order to: NL65INGB0006822606 . During this period ebby port will reserve the product(s) for you. If the full payment is not received in these 7 working day period the items will be released for selling.
6.3 As stated in article 4.2 you will receive a conformation e-mail of your order with the invoice attached after you placed the order. After receiving the full payment ebby port will pack the item and send an e-mail containing the information regarding the shipment.
6.4 If you pay by credit card you confirm that the credit card that is being used is yours.
6.5 All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of the payment card refuses to authorize payment to ebby port, delivery of the items will be postponed and ebby port will contact you. In that case ebby port shall not be liable for any delay or non-delivery.
Article 7. Shipping
7.1 As soon as the payment is received by ebby port the purchased product(s) will be shipped via DHL. The delivery time is depended of the shipping destination. For the approximate shipping duration of your country see the following table.
7.2 ebby port shall do its utmost to deliver all items within the periods as indicated in this link. However, for this ebby port is dependent on DHL. Therefore the delivery periods are indicative only and ebby port shall never be liable for the consequences of exceeding the term of delivery and is never required to recover any kind of damage.
7.3 As stated in article 6.3 ebby port will send a confirmation by e-mail also containing the information regarding the shipment after receiving the full payment.
7.4 The cost of the shipping and handling are as following according to country:
There are three different rates. All shipping in the Netherlands, Belgium and Germany is free of cost. If you live in another EU country the shipping cost is €11. If you live outside of the EU the shipping cost are €24.
7.5. The risk of damaging the product(s) or when the product(s) go missing shall pass from ebby port to the addressee upon delivery.
7.6 You are required to inspect the delivered product(s) on completion and deficiency within 7 working days after delivery. In case of any alleged incompleteness or defect you must give notice to ebby port by e-mail within this period of 7 working days.
Article 8. Returns and exchanges
8.1 All product(s) purchased online from ebby port can be returned or exchanged after notifying ebby port within 7 working days upon delivery by e-mail: info@ebbyport.com. Notification must take place by e-mail with the reason for return and the original invoice must be enclosed.
8.2 Notification shall automatically terminate the agreement between you and ebby port. This obliges you to return the product(s) with the original seal intact to ebby port within 7 days after notification.
8.3 All returned product(s) must be in new, unused, and unworn condition with the original seal intact and the garment tag still attached. New and unused means that there are no marks on the product(s), or anywhere on the tag(s), no smell on the product(s), no traces of the product(s) having been worn or washed.
8.4 You will be responsible to pay for the shipping costs, unless we have delivered incorrect product(s).
8.5 All accurately returned product(s) can only be exchanged for the same product in a different size if the same product is still available in the same color, for the same price. This product will then be sent back to you free of charge within 7 working days after ebby port received the exchanged product.
8.6 All accurately returned product(s) will be credited as a refund (the refund does not include the paid shipping costs) to your credit card or bank account within 14 days of receiving back the returned product(s). The time the refund will be on your credit card or bank account depends on the payment method you used.
After receiving the accurately returned product(s), you will receive a credit note by e-mail.
8.7 In case the returned product(s) are not in the perfect condition they were sent, the product(s) will be sent back to you and the agreement between you and ebby port will not have been terminated. The shipping cost for sending the package back to you, will be invoiced.
8.8 ebby port does not refund customs and import duties or sales taxes for shipments to countries inside and outside the European Union.
8.9 ebby port does not accept returns on items that were not purchased through the website.
Article 9. Privacy and liability
9.1 ebby port respects your privacy following the Law for the protection of Personal information. Information you provide through this website will be used confidential and ebby port shall never provide information about you to third parties.
9.2 The information you provide through this website will only be used to process your order.
Article 10. Use of site
10.1 Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including an ebby port or representative, other licensed employee(s), website host, members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organisation.
